There is "no" salvation in water baptism. Think about the sinner who was on a cross next to Jesus, when he ask Jesus to remember him and Jesus said, today you will be with me in paradise. He did not get down from the cross and go get water baptized. Water baptism is a action taken by a born again believer who wants to let others know that he has excepted Jesus as His Lord and Savior and has repented of his sins. It's a confession that you are saved. That you are a new creation in Christ Jesus, that you died with Him, are buried with Him and raised in the newness of Life in Christ Jesus. Hallelujah!
1 Corinthians 1:17: For Christ sent me not to baptize, but to preach the gospel: not with wisdom of words, lest the cross of Christ should be made of none effect.
If water baptism was a requirement for salvation Christ would have sent Paul the apostle to baptize. However, Paul was not sent to water baptize but to preach the gospel of which water baptism is not an essential element.
Romans 1:16-17 (KJV): For I am not ashamed of the gospel of Christ: for it is the power of God unto salvation to every one that believeth; to the Jew first, and also to the Greek. For therein is the righteousness of God revealed from faith to faith: as it is written, The just shall live by faith.
Ephesians 2:8-9 (KJV): For by grace you have been saved through faith, and that not of yourselves; it is the gift of God, not of works, lest anyone should boast.
Works, including that of water baptism, do not save. We are saved by grace through FAITH in Jesus Christ.
Water baptism is an ordinance and an outward practice for the inward work done by Christ when we're saved by Grace. I also agree that when Jesus speaks of water in John 3 to Nicodemus; he's referring to physical birth...no water baptism as an ordinance.
Religion (catholicism being one) teach that it is Salvation but they add sacraments and other works to that process thus showing how they've frustrated the simple Grace of Jesus Christ.
I agree Homer, John 3:3-6, seems to indicate that Jesus' mention of 'water' is metaphorical of human birth. When Nicodemus was thinking that this new birth was an actual physical birth (v4), and when Jesus then (in v6) reiterates that what "is born of the flesh is flesh; and that which is born of the Spirit is spirit", show that 'water' must refer to physical birth & not a future 'water baptism'. The whole focus of this passage was to clear Nicodemus' mind that Jesus wasn't speaking of a second physical birth. Man has to be born into this world first & then born again of the Spirit to be saved.
And indeed, if water baptism is an essential part of salvation's work, then, as you mentioned, those who die suddenly, or who are incapable of being baptized, or by neglect of the evangelist, will then suffer complete rejection by God, even if they have called upon Him in faith. Water baptism is an important first step for the new believer, but never to be part of salvation by faith, or else, salvation is no longer of faith.

Jesus tells us in John 3, how to be saved. We must be born again; and given the Holy Spirit.
Water baptism is not mandatory. It is an act of obedience, worship, a deep desire to leave a sinful past and feel clean. Some people need that and want it.
It is solely Jesus who baptizes with the Holy Spirit. Jesus knows what we need.
It is not anyone else's business to say, do it this way or else you're not saved properly.

I woke up the next day, conscious of Someone telling me what to do. I cleaned house of anything He said that was occult. Two days later, I had a bonfire in my trash can. Acts 19:19. The Holy Spirit has never left me. He tells me daily about Jesus, what scriptures mean. It's been 36 years of trust, love, praise and worship for my Father and my Lord Jesus. His blood has saved my life many times. Jesus wrote my name in the book of Life before I even knew of it.
God does things how He chooses to bring us into the Kingdom. He gave me the Holy Spirit who has taught me everything I know. I don't have a library of books. Just a Strongs. Life is sweet. People come to God the easiest way possible. Softly or Rough like me. I know how much Paul loved his life despite the bad parts. It's the Blessed Hope of the moment we lay eyes on Jesus again. Tell people of the Love, not legalism. Love put Him on the Cross to shed His blood to give us His Life.
Verse 23-Jehovah God left the Israelites to their own downfall. They chose to go after other gods so he let them. God does not force us to serve him but he will also not shield us from the consequences of choosing to serve other gods.

The example that you stated of Jesus forgiving the thief on the cross was "a special act of mercy" for the thief, NOT a message to "all mankind" to go ahead and keep sinning and just say that you believe in Christ and you will be saved. That message of just believing is a FALSE MESSAGE! Even the devil and his demons believe, are they going to heaven too?
We must not only believe, we must be baptized in water, receive the Holy Spirit, also REPENT, and lead a good christian life following the gospel of Jesus Christ.
Jesus/God's message is plain for all to see. We can't just ignore what Jesus instructs us to do. There is so much scripture of Jesus telling us what we need to do, to enter into the kingdom.

Mark 16:15 KJV says "... Go ye into all the world, and preach the gospel to every creature.". That is an order from God and even though it's hard to talk to people right now, we have electronics, we can still spread the gospel. We don't know what will happen or when so we need to tell people about God's word and what he did for all ( John 3:16) it woul be our fault if we knew someone was not saved and we didn't do anything about it and they go to hell to spend eternity.
Adams, Judg 2:18 speaks of people appointed by God to rule over His people & to guide them in His Ways. They were a pre-cursor to the appointment of the kings, of whom Saul was the first. This Scripture doesn't tell us about those called to be evangelists. We are all tasked with the ministry of the Gospel to the unsaved, whether one to one, or en masse. So much so as we see the Day of the Lord coming.

The Israelites did not listen to God and so in verse 3 they had to suffer the consequences of their actions. Anyone who disobeys God will eventually have to face the bad consequences of their actions.

Christ promised the thief on the cross LIFE when the kingdom of God was made available by the death of Christ.
If you have to be water baptisted, then the thief will never be able receive Christ's promise.
Christ word's can not be broken; therefore it's water baptism that does't stand.
John baptised with water, God baptises with SPIRIT.
